Legal aid
Legal Aid or Public funding is now not available for most Personal Injury Claims. You may be eligible to claim public funding if you are making a clinical negligence claim and have a low income and savings.
Conditional Fee Agreements
“No win no fee”
Conditional fee agreements are agreements between a client and lawyer which mean that you pay us nothing if you lose a case. If you win, you can usually recover most of your costs from the other side, including the uplift and insurance you may have taken out to cover the costs in the event of losing.
We would be happy to arrange after the event insurance on your behalf to protect you from having to pay your opponent’s costs if your claim is unsuccessful. There are a number of insurance policies available.
Paying privately
You can pay for your claim privately and we would be pleased to provide you with an estimate of likely costs. We are happy to consider payment of costs in instalments and will at all times keep you closely informed as to the level of costs spent on your behalf.
If you proceed with private instruction you run the risk of having to pay all our costs and your opponent’s costs if you lose the claim (although you may be able to take out insurance against your opponent’s costs). If you win your claim, the majority of costs will normally be recoverable from your opponent.
Legal expenses insurance
You may already have this insurance within your house or car insurance policies, or through membership of a trade union or some other such organisation. It is important that you check to see if you have such insurance cover and we can help you with this.
