Jackson on-side re Legal Aid

Lord Justice Jackson has urged the government to retain legal aid for clinical negligence cases.

During a speak to the University of Cambridge Faculty of Law, he said that ‘of all the proposed cut backs in legal aid, the removal of legal aid from clinical negligence is the most unfortunate’.

The Judge also added:

“in the final report I resisted the strong temptation to recommend that legal aid be restored to its scope pre-April 2000 … because I recognised that such a proposal would be unrealistic and would stand no chance of implementation”.

Jackson had advised the government in his report on civil costs that legal aid should be retained in cases of medical blunders, but the Ministry of Justice (MOJ) has pushed ahead with proposals to cut it regardless.
