
Government favours the defendant

This week brought bleak news for injured people, as despite polarised views in responses to the consultation on civil justice reform, the Government has favoured the defendant. The myth of a 'compensation culture', which Lord Young admitted in his report is more perception than reality, has been peddled in an effort to cut costs.
Secretary of State for Justice Ken Clarke announced (29 March) the intention to push ahead with proposals to abolish the recoverability of success fees and have claimants pay the fees from up to 25 per cent of their damages.
