Fixed Fee Divorce
3rd Oct 2011
Divorcing couples who fear the costs of their dispute will escalate out of control are being offered financial comfort by a regional law firm.
BHP Law has become one of the first legal practices in the North East to offer fixed fee divorces.
It means that parting couples whose cases do not involve arrangements for children or the carving up business assets can have the legal cost of their divorce confirmed at the outset.
Richard Deas, a senior consultant solicitor in BHP Law’s family division, explained: “We recognise that clients do not like open-ended retainers where they are unsure what the final cost is going to be. Understandably they like certainty, particularly in difficult times.
“We have devised a range of packages, from the simple divorce with no dispute to cases where arguments over finances require a court hearing. With any of these, the cost is clearly set out.”
The packages begin at £150 for a client who is being divorced by their spouse.
It is the first time BHP Law, which has offices in Newcastle, Durham, North Shields, Darlington, Newton Aycliffe, Stockton and Halifax, has offered fixed fee divorces, an arrangement that is rare among North East law firms.
Richard added: “You can find fixed fee divorce online but this is typically a paper exercise only and it is unlikely to be experienced, qualified solicitors who handle the case.
“In all cases we ask clients to meet us in person and fill in a questionnaire. Even in the lowest cost option we provide clients with an overview of their situation and advise them about general divorce proceedings.
“The packages become more detailed depending upon the level of agreement, or lack of, between spouses. We have a very experienced team of family lawyers who are committed to helping people resolve their problems calmly and will explore whether informal mediation or collaborative law is a suitable way forward.
“Often with a little bit of guidance it is possible to sort out matters without very expensive court proceedings, which is why we have decided to offer a range of fixed fee services to meet a number of different, yet relatively typical, situations.”
