Will you need to attend a Mediation Information and Assessment Meeting (MIAM)?

Growing numbers of solicitors in the North East are training to be family mediators following new demands on separating couples to resolve disagreements outside court.

Since April, the rules have changed for couples who are planning to divorce or end a civil partnership and want to apply for a court order over money, property, possessions or about arrangements for their children.
 
They must now provide a completed FM1 form with their application confirming that they have attended a Mediation Information and Assessment Meeting (MIAM) or explaining why they are exempt.
 
The rules also apply to all parents and family members in dispute over the arrangements for children.
 
Margot Moffitt, an experienced family law specialist at BHP Law in Newcastle, explained: “Many people are discovering that family mediation is a way of solving disagreements without involving the courts. It aims to help people find a solution that meets their needs and is fair to them, their partner and especially any children.
 
“Since April 6 this year, the court can ask couples who have not been to one of these meetings to do so before it proceeds with their case. Consequently more solicitors are training in this area to meet the new requirements.”
 
BHP Law’s Family Mediation service is long established and all its mediators are fully accredited and experienced.
 
Margot added: “We provide couples with a safe, discreet and neutral setting to talk and try and resolve family disputes. The family mediator does not take sides and any arrangements made through family mediation are not legally binding.
 
“Our clients meet the family mediator alone, and only proceed with mediation if they feel happy to do so. The family mediator then contacts the spouse to find out if they are willing to give mediation a try.”
