In order to obtain a divorce you must have been married for at least 12 months. The only ground for a divorce is on the basis of irreconcilable breakdown of marriage. This can be based on either :
- Adultery;
- Unreasonable behaviour;
- Desertion for more than 2 years;
- 2 years separation with the other party's consent;
- 5 years separation.
How long will it take?
A divorce that has no other issues (including financial or children disputes) will usually take between 3 to 6 months to be finalised. A divorce is obtained in two parts, Decree Nisi being the first part of your divorce and Decree Absolute brings your marriage to an end. In most cases there will be no need for you to go to court.
How much will it cost?
