Paul Monaghan joined BHP in 2007 having previously worked for law firms in the North East and in London, where he specialised in a range of commercial matters. At BHP Law Paul specialises in Corporate Recovery & Insolvency Law and Commercial Litigation. He is a graduate of the University of York, the University of Northumbria, the University of Edinburgh and the College of Law of England and Wales.
Paul acts for a range of individuals and large private sector organisations in and outside of the North East region.
Paul’s practice and experience in the area of Corporate Recovery and Insolvency is primarily on the side of the Licensed Insolvency Practicioner in their role as appointment holder, whether that be as Nominee/Supervisor, Trustee, Administrator or Liquidator. Paul advises appointment holders on both contentious and non-contentious matters. Many of the contentious matters which Paul deals with relate to, amongst other things, misfeasance claims, wrongful trading, fraudulent trading, transactions at an undervalue, private examinations, contested bankruptcy petitions and contested winding up petitions. In addition, Paul advises on a variety of issues arising from the provisions of the Companies Act 2006 and the Insolvency Act 1986. He is one of a limited number of Solicitors who hold the Higher Rights of Audience (All Courts Proceedings) qualification and as a result he is instructed to conduct litigation and appear as advocate in both the lower and higher Courts.
Paul’s practice and experience in the area of Commercial Litigation is also wide ranging. His primary role is to act on behalf of individuals and company directors handling contentious matters on their behalf. As a result he is often involved in a wide range of disputes relating to, amongst other things, commercial contracts, partnership disputes, breach of statutory duty, construction and building claims, property disputes, disputes under the Sale of Goods Act 1979 and disputes under the Consumer Credit Act 1974. In addition, by virtue of holding the Higher Rights of Audience qualification Paul is often called upon to provide his opinion on procedural and evidential matters in proceedings before the lower and higher courts and to appear as advocate throughout the proceedings.
Paul is a member of R3, the Insolvency Lawyers Association and the Solicitors Association of Higher Court Advocates.
